Terms of Service

These Terms of Service ("Terms") govern your use of the Orbit app and related services. Orbit is a location-based social meetup app for iOS operated by Catalyst Apps LLC ("Orbit," "we," "us," or "our"). Please read these Terms carefully.

Acceptance of Terms

By creating an account or otherwise using Orbit, you agree to be bound by these Terms. If you do not agree, please do not use the service.

Eligibility

You must be at least 17 years old to use Orbit. By using the service, you represent that you meet this age requirement and that you are able to enter into a binding agreement.

Your Account

You are responsible for the activity that happens under your account. You agree to provide accurate information, to keep your login credentials secure, and to notify us promptly of any unauthorized use of your account.

Acceptable Use

When using Orbit, you agree not to:

• Harass, threaten, bully, or abuse other users;
• Engage in or promote illegal activity;
• Post spam or send unsolicited promotions;
• Impersonate any person or entity, or misrepresent yourself;
• Scrape, harvest, or collect data from the service through automated means;
• Attempt to disrupt, compromise, or gain unauthorized access to the service or its systems.

User Content and License

You own the content you create on Orbit, including your profile, hangouts, and messages. By posting content, you grant Orbit a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content as necessary to operate and provide the service. You are solely responsible for the content you post and for ensuring you have the rights to share it.

Objectionable Content and Zero Tolerance

Orbit has zero tolerance for objectionable content and abusive behavior. You may not post, share, or transmit content that is unlawful, hateful, harassing, threatening, defamatory, sexually explicit, or that promotes violence, discrimination, or self-harm, and you may not use Orbit to abuse, exploit, or endanger others.

Orbit provides tools, available throughout the app, to report content or users and to block anyone you do not wish to interact with. We review reports of objectionable content and abusive users and act on them within 24 hours by removing the content and ejecting the user who provided it where appropriate. Hangouts and In-Person Safety

Orbit connects people for in-person meetups, but we do not conduct background checks on users and we do not verify or vet the people you meet. Your interactions and any in-person meetings are entirely at your own risk.

To help stay safe, we strongly encourage you to:

• Meet in public places, especially the first time;
• Tell a friend or family member where you are going;
• Use good judgment and trust your instincts;
• Leave any situation that feels unsafe or uncomfortable.

You understand and accept that you assume the risks of communicating with and meeting strangers and of attending events arranged through Orbit.

Hosting Hangouts

If you host a hangout, you set the activity and its details, and you are responsible for organizing and conducting it responsibly and lawfully. Hosts should provide accurate information and foster a welcoming, safe environment.

Third-Party Services

Orbit relies on third-party services, including Supabase, Railway, and Apple, to operate. Your use of those services may be subject to their own terms, and we are not responsible for the practices of third parties.

Disclaimers

Orbit is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, Orbit and Catalyst Apps LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the service. In particular, Orbit is not liable for the conduct of other users or for any in-person interactions or meetings arranged through the service.

Indemnification

You agree to indemnify and hold harmless Orbit and Catalyst Apps LLC from any claims, damages, or expenses arising out of your use of the service, your content, or your violation of these Terms.

Termination

We may suspend or terminate your access to Orbit at any time if you violate these Terms or if we need to protect the community. You may stop using Orbit and delete your account at any time.

Governing Law

These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict-of-laws principles.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice within the app. Your continued use of Orbit after changes take effect constitutes acceptance of the updated Terms.
